Terms and Conditions

§1. General provisions

These Terms and Conditions govern the use of the online store available at https://hesp.pl/ and the rules for concluding sales and service agreements with HESP Sp. z o.o. with its registered office in Poznań (ul. Święty Marcin 29/8, 61-806 Poznań), KRS: 0001178327, NIP: 7831931118, REGON: 541987705 (the “Seller”).
The Terms are made available free of charge before concluding an agreement and at all times on the Store website.
The Customer is obliged to read the Terms before placing an order.

Store — the online store operated by the Seller.
Customer — a natural person, legal entity or organisational unit using the Store.
Consumer — a Customer who is a natural person entering into a legal transaction not directly related to their business or professional activity.
Product — goods available in the Store, in particular pool accessories, equipment and materials.
Service — design, construction, maintenance or consulting services offered by the Seller in the pool sector.
Agreement — a product sales agreement or service agreement concluded between the Seller and the Customer.

Information about Products in the Store, including descriptions, photos and prices, constitutes an invitation to conclude an agreement within the meaning of the Civil Code.
Orders are placed via the Store form. Placing an order constitutes an offer to conclude an agreement.
The agreement is concluded when the Seller confirms acceptance of the order, sent to the Customer electronically.
The Seller may refuse to fulfil an order if the Product is unavailable, there is an error in the offer, or the Customer provided false data.

Product prices are given in Polish zloty and include VAT unless stated otherwise.
Delivery costs are shown during the ordering process before the order is placed.
Available payment methods are specified in the Store at the time of ordering.
For individual services (e.g. pool construction, design), payment terms are agreed individually in the offer or contract.

Orders are fulfilled after payment is received or according to the selected deferred payment method.
Delivery time is usually 2 to 14 business days unless a different term is indicated for the Product.
The risk of accidental loss or damage to the Product passes to the Customer when the shipment is handed to the carrier or collected in person.

A Consumer has the right to withdraw from a distance contract within 14 days without giving a reason.
The period runs from the day the Consumer or a person indicated by them takes possession of the Product.
To exercise the right of withdrawal, the Consumer should notify the Seller at: sklep@hesp.pl.
The right of withdrawal does not apply in cases provided for by consumer protection law, in particular for goods made to individual order.

The Seller is liable to a Customer who is a Consumer for Product conformity with the agreement under consumer protection law.
Complaints regarding Products or Services should be sent to: sklep@hesp.pl, including a description of the issue and order number.
Complaints will be handled within 14 days of receipt.

Design, construction and maintenance services provided by the Seller require individual pricing and contractual terms.
The detailed scope of work, schedule, warranties and payment terms are specified in the contract or commercial offer.
Marketing information on the website is for information purposes only and does not constitute an offer within the meaning of the Civil Code unless stated otherwise.

Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code and consumer protection regulations.
The Seller reserves the right to amend the Terms for important reasons. Changes take effect upon publication on the Store website.
These Terms apply from the date of publication on the Store website.
